Bar Essay Prep Terms of Service
The purpose of Bar Essay Prep is to allow users to test their knowledge of bar exam subjects, it does not intend to teach the law and should not be relied upon for such a purpose. Access to Bar Essay Prep is granted until March 15, 2009. During this time you can submit a total of 3 submissions per essay for each of the 30+ bar essays. Access is granted for a single student per account. You may not share your account with anyone else. At the time of enrollment, there shall greater than 30 bar exam essay questions available.
It is understood that Bar Essay Prep may experience temporary periods of downtime or the user may experience unforeseen glitches. The purchase price of $30 reflects these possibilities, and user accepts that no refunds will be available on the basis of such a claim. Idea Works, Inc. does intend to provide a valuable service and requests that user give notice of any problems or issues with Bar Essay Prep.
Idea Works, Inc. reserves the right to withhold service from anyone who violates the terms of this agreement. Idea Works, Inc. makes no promise that Bar Essay Prep service will always be available. There may be occasional brief periods where planned or unscheduled maintenance is required or access through our Internet Service provider is unavailable. We will make reasonable efforts to minimize any such gaps in service.
Idea Works, Inc. disclaims all warranties and representations, whether express, implied, or otherwise. Idea Works, Inc. shall not be liable to you or any third party for any indirect, special, incidental, punitive, or consequential damages arising out of the use of, or inability to use, the software based on any theory of liability including breach of contract, breach of warranty, tort, product liability or otherwise. Idea Works, Inc.'s total liability to you for actual damages for any cause whatsoever will be limited to the amount paid by you for the software that caused such damage. The foregoing limitations on liability are intended to apply to the warranties and disclaimers above and all other aspects of these terms.
These terms contain the complete agreement between the parties with respect to the subject matter hereof, and supersede all prior or contemporaneous agreements or understandings, whether oral or written. You agree that any varying or additional terms contained in any purchase order or other written notification or document issued by you in relation to the Software licensed hereunder shall be of no effect. The failure or delay of Idea Works, Inc. to exercise any of its rights under these terms of service or upon any breach of these terms of service shall not be deemed a waiver of those rights or of the breach.
If any provision of these terms shall be held by a court of competent jurisdiction to be contrary to law, that provision will be enforced to the maximum extent permissible, and the remaining provisions of these terms will remain in full force and effect.

Permission to use the NCBE’s questions does not constitute an endorsement by NCBE or otherwise signify that NCBE has reviewed or approved any aspect of these materials or the company or individuals who distribute these materials.
